MixingBoard Privacy Policy

1. Introduction and Who We Are

MixingBoard LLC ("MixingBoard," "we," "our," or "us") operates the MixingBoard platform — a two-sided marketplace connecting Gig Hosts (churches, event organizers, and other talent-seeking parties) with Performers (musicians, singers, and other musical talent). MixingBoard is the brand name under which MixingBoard LLC operates this platform.

This Privacy Policy describes how we collect, use, disclose, and protect information about you when you access or use the MixingBoard mobile application and related services (collectively, the "Platform"). It also explains the rights and choices you have with respect to your information.

By accessing or using the Platform, you agree to the collection and use of your information as described in this Privacy Policy. If you do not agree, please do not use the Platform.

2. Scope and Applicability

This Privacy Policy applies to all users of the MixingBoard Platform, including users acting as Hosts, users acting as Performers, and users who operate in both roles. It applies to use of the Platform through our mobile application (iOS and Android) and any related web interfaces.

This Policy does not apply to the data practices of third-party services we integrate with. Those services operate under their own privacy policies, which are referenced in Section 9 of this Policy.

3. Information We Collect

3.1 Information You Provide Directly

We collect information you provide when you register an account, set up or update your profile, post gigs, submit applications, or communicate through the Platform. This includes:

When you pay to post a gig or purchase other paid features, payment is processed by Stripe, Inc. We collect and store only a Stripe customer identifier linked to your account. We do not collect, store, or have access to your card number, CVV, expiration date, or other sensitive payment data. That information is handled exclusively by Stripe. See Section 9 for Stripe's privacy policy.

3.3 Location Data

Location data is collected from text you enter (city and state). This text is geocoded into latitude and longitude coordinates by Mapbox on our servers, for the purpose of enabling distance-based gig and performer search. The Platform does not access your device's GPS sensor or location services. Location data constitutes personal information under applicable privacy laws, including the CCPA.

We use this information to operate, maintain, and improve the Platform.

3.6 Crash Reporting

The mobile application uses Sentry to collect crash and error reports. These reports may include limited technical information about your device and application state at the time of a crash. While no intentional collection of personally identifiable information occurs through crash reporting, incidental inclusion of PII cannot be fully excluded. Crash data is subject to Sentry's privacy policy (https://sentry.io/privacy/).

3.7 Push Notification Tokens

If you enable push notifications, we collect and share your device token with OneSignal for the purpose of delivering notifications related to messages, application status updates, and other Platform events. See Section 9.

3.8 Information We Do Not Collect

We do not collect information from third-party data brokers or resellers. We do not collect information from social media platforms about your activity on those platforms. We do not use cookies or other tracking technologies in connection with the mobile application.

4. How We Use Your Information

We use the information we collect for the following purposes:

5. How We Share Your Information

We share your information only as described below.

5.1 With Other Users

Certain profile information is visible to other users as part of the Platform's core functionality. When you act as a Performer, your name, profile image, skills, biography, location (city and state), and public ratings are visible to Hosts reviewing applications. When you act as a Host, your name, organization name, profile image, location, and public ratings are visible to Performers browsing or applying to gigs; your website URL, if provided, becomes visible to Performers only after they have submitted an application to one of your gigs. You control the content you choose to add to your profile.

5.2 With Service Providers

We share information with third-party service providers that perform services on our behalf, including authentication (Auth0), payment processing (Stripe), location geocoding (Mapbox), cloud hosting and storage (Amazon Web Services), push notifications (OneSignal), transactional email (Mailgun), and crash reporting (Sentry). These providers are permitted to use your information only to perform services on our behalf and are prohibited from using it for other purposes. See Section 9 for a full list.

5.3 For Legal Compliance and Protection

We may disclose your information to law enforcement agencies, courts, regulators, or other third parties where we believe disclosure is required by applicable law, court order, or regulation, or where necessary to protect the rights, property, or safety of MixingBoard LLC, our users, or others.

5.4 In Connection with Business Transfers

In the event of a merger, acquisition, sale of assets, or similar transaction involving all or part of our business, your information may be transferred to the acquiring entity, provided it is used consistent with this Privacy Policy.

5.5 With Your Consent

We may share your information with your consent or at your direction in circumstances not otherwise described here.

5.6 Aggregated or De-identified Data

We may share aggregated or de-identified information that does not identify you individually for any lawful business purpose.

6. Messaging and Message Retention

Direct messaging between a Host and a Performer is only enabled after the Performer has submitted an application to a specific gig position. Messages are not end-to-end encrypted. We retain full access to all platform messages for purposes of safety review, dispute resolution, and legal compliance. Message content is stored in plaintext.

Users may not delete individual messages. All messages are retained as part of the Platform's audit trail. If your account is deleted, messages you sent remain in conversations attributed to an anonymized identifier.

7. Data Retention

We retain your personal information for as long as your account is active and for a period thereafter as necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements.

Data held by third-party processors (Stripe, Auth0, OneSignal, etc.) is subject to their respective data retention policies. You may contact those providers directly to exercise deletion rights under their terms.

8. Security

We implement reasonable administrative, physical, and technical safeguards designed to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include network security controls, data encryption in transit, and access controls.

Authentication credentials are managed by Auth0 and stored securely on your device using iOS Keychain (iOS) or Android Keystore (Android). You are responsible for the security of your device. We are not liable for unauthorized account access resulting from device compromise, loss, or theft.

No method of internet transmission or electronic storage is completely secure. We cannot guarantee the absolute security of your information.

The Platform relies on the following third-party service providers. Each operates under its own privacy policy, to which your use of their services is subject:

MixingBoard LLC is not responsible for the data practices of these third-party providers.

10. Children

The Platform is intended for users who are at least eighteen (18) years of age. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a person under 18 without parental consent, we will delete that information promptly. If you believe we may have collected information from a child under 18, please contact us at admin@mixingboard.com.

11. Your Rights and Choices

11.1 Access, Correction, and Deletion

You may access and update your profile information at any time through the Platform's account settings. You may request deletion of your account through the in-app settings. See Section 7 for details on what happens when you delete your account.

11.2 Push Notifications

You may disable push notifications at any time through your device settings. Disabling push notifications will not affect your ability to use the core features of the Platform.

11.3 Marketing Communications

We may send you transactional and service-related emails. If you receive any promotional or marketing communications from us, you may opt out by following the unsubscribe instructions in the email. Please allow up to 10 business days for opt-out requests to take effect.

11.4 California Residents

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

Right to Know. You may request information about the categories and specific pieces of personal information we have collected about you, the sources from which it was collected, the purposes for which it is used, and the categories of third parties with whom it is shared.

Right to Delete. You may request deletion of personal information we have collected about you, subject to certain exceptions permitted by law (such as our need to prevent fraud and maintain promotion usage records, as described in Section 7).

Right to Opt-Out of Sale. We do not sell personal information as that term is defined under the CCPA.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

Authorized Agents. You may designate an authorized agent to submit requests on your behalf. We will require written proof of the agent's authority and may verify your identity directly.

California Shine the Light (Civil Code § 1798.83). California residents may request information about personal information shared with third parties for their direct marketing purposes during the preceding calendar year. 12. Updates to This Privacy Policy

We may update this Privacy Policy from time to time as the Platform evolves or as required by law. When we make material changes, we will post the updated Policy on the Platform with a revised "Last Updated" date and, where appropriate, notify you through the app or by email. Your continued use of the Platform following any update constitutes your acceptance of the revised Policy.

13. Governing Law

This Privacy Policy is governed by the laws of the State of Maryland, without regard to its conflict of law provisions, consistent with our Terms and Conditions.
